  • Use of the home: lodging only — no parties, receptions, or events. If you expect a few daytime visitors, please ask us in advance.
  • Cancellation: 100% refund 14+ days before check-in; 50% refund 7–13 days before check-in; no refund fewer than 7 days before check-in, except where required by law or if we cancel because the home is unavailable.

This Agreement applies to the reservation dates, guest count, and charges shown at checkout and in the booking confirmation.

1. Who Is Booking

The person completing the reservation ("Guest" or "you") confirms that they are at least 21 years old, will be present at the Property during the Stay, and are responsible for the conduct of everyone included in or invited under the reservation. Please make sure the name, contact information, guest count, and pet information on the reservation are accurate before arrival.

2. Reservation, Price, and Payment

The total price shown at checkout and confirmed after booking is the amount due for the Stay, including the nightly rate and any taxes, cleaning charge, pet charge, or other fee specifically disclosed at checkout. Payment is due according to the terms shown during checkout. If the booking page identifies a refundable security deposit or card authorization, that specific disclosure also applies.

3. Cancellation and Refunds

We understand that plans sometimes change. The cancellation policy is: 14 or more days before check-in — 100% refund of amounts paid; 7–13 days before check-in — 50% refund of amounts paid; fewer than 7 days before check-in — no refund. A cancellation is effective when it is submitted through the booking account or received by us in writing. Refund processing time depends on the original payment method. Travel interruptions, weather, illness, or changes in personal plans do not automatically create an exception to this policy, so travel insurance may be worth considering. We will always honor any refund required by applicable law. If we cancel because the Property is unavailable for your Stay, Section 12 applies.

4. Guests, Visitors, and Pets

The Property may host a maximum of 10 overnight guests and up to 2 approved pets. Please keep the reservation guest count current. If your group changes before arrival, contact us — we can usually update the reservation as long as the maximum occupancy is not exceeded and any applicable charge is addressed. A small number of daytime visitors may be allowed with advance approval — submit a visitor request from My Trip once you have a confirmed reservation. Visitors may not create a party, event, parking issue, neighborhood disturbance, or occupancy level beyond what the Property and community can reasonably accommodate.

5. No Parties or Events

Delphinium Haus is intended for lodging and normal social use by the registered group. Weddings, receptions, parties, ticketed events, commercial events, or other gatherings that turn the home into an event venue are not permitted. We know guests often stay with us while attending weddings, tournaments, family celebrations, or other events nearby — that is absolutely fine. The restriction is on hosting the larger event at the Property itself.

6. House Rules and Neighbor Courtesy

You agree to follow the House Rules provided with the reservation and at the Property. Important rules include respecting posted quiet hours, no smoking on the Property, parking only where permitted, using the smart lock responsibly, and leaving the home reasonably secure whenever your group is away. Community and HOA rules that apply to guests are also part of the Stay. If a rule issue comes up, our first step will normally be to contact you and work it out. Repeated or serious violations may be handled under Section 10.

7. Damage, Missing Items, and Extra Cleaning

Accidents happen. If something is damaged, lost, or not working properly, please tell us promptly so we can help and avoid a small issue becoming a larger one. You are responsible for the reasonable cost of damage beyond normal wear and tear, missing items, extraordinary cleaning caused by the reservation, or material charges resulting from an unauthorized pet, event, or occupancy violation. Where a charge is appropriate, we will make reasonable efforts to notify you of the issue and the basis for the charge before processing it. By completing checkout, you authorize us to securely save the payment method used for your reservation and, to the extent permitted by applicable law and our payment processor's rules, to charge that payment method after your Stay for amounts properly due under this Section.

8. Amenities, Pool Access, and Alcohol

Please use the home and its amenities with ordinary care, follow posted instructions, and supervise children and anyone who may need assistance. Community amenities — including Norton Commons pools — are operated by the community or HOA, not by Delphinium Haus. Their hours, access procedures, seasonal schedules, capacity limits, and rules may change and are outside our control. The Bourbon Lounge is an amenity of the home. Any alcohol brought to or consumed at the Property is the responsibility of the Guest and their party, and all applicable age and alcohol laws must be followed. We do not authorize unsafe or unlawful use of any amenity.

9. Privacy and Security Devices

No cameras or recording devices are used inside the home or anywhere on the Property where a guest would have a reasonable expectation of privacy. The Property has two exterior security devices, both facing outward only and used solely for property and entry security, never to monitor guest activity: a video doorbell at the front entrance and a security camera at the garage entrance.

10. When a Stay May Be Ended Early

We want every stay to go smoothly, and ending a reservation early is a last resort. When reasonably possible, we will contact you first and give you an opportunity to correct a concern. A Stay may be ended without refund, to the extent permitted by law, for a serious or continuing material violation such as an unauthorized party or event, occupancy above the stated maximum, illegal activity, significant property damage, conduct that threatens safety, or repeated neighborhood disturbance after notice.

11. Community Rules and Applicable Law

The Stay is subject to applicable Kentucky law, local requirements, and community/HOA rules that lawfully apply to short-term-rental guests. Taxes and charges imposed on the reservation are included or separately shown at checkout as applicable. If a community amenity has its own rules — for example, pool access procedures — those rules must be followed while using that amenity.

12. If the Property Becomes Unavailable

If the Property becomes unavailable or uninhabitable before check-in because of fire, flood, major mechanical failure, or another condition that prevents us from reasonably providing the Stay, we will notify you as soon as practical and refund the amounts paid for the affected Stay. If a similar issue materially interrupts the Stay after check-in, we will work with you in good faith on the appropriate remedy for the affected portion of the reservation. We may also help identify alternative lodging when practical, but we cannot guarantee another property will be available at the same price or location.

13. Personal Belongings and Ordinary Use Risks

Please take normal care with personal belongings and while using stairs, outdoor areas, pools, appliances, furniture, and other amenities. You remain responsible for supervising children and members of your party. Except to the extent caused by our negligence or otherwise required by law, we are not responsible for loss of or damage to personal belongings or for injuries arising from a guest's misuse of the Property or failure to follow posted safety instructions. Nothing in this Agreement waives a right or responsibility that cannot lawfully be waived.

14. Questions and Disputes

If something is not right, please contact us promptly so we have a fair opportunity to address it during the Stay. Most issues are best resolved quickly and directly. This Agreement is governed by Kentucky law. If a dispute cannot be resolved informally, either party may bring the matter in a court with proper jurisdiction in the county where the Property is located, unless applicable law requires a different forum.

15. Entire Agreement and Booking-Specific Terms

This Agreement, the House Rules, the cancellation policy, and the booking confirmation together form the agreement for the Stay. Booking-specific details shown at checkout or in the confirmation — such as dates, guest count, approved pets, price, and any specifically disclosed deposit — control over general website descriptions. If any provision of this Agreement is unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law.

Electronic Acceptance

By checking the acceptance box and completing payment, you confirm that you are at least 21 years old and agree to this Guest Rental Agreement, the House Rules, and the cancellation policy. Your electronic acceptance becomes part of the booking record.
